Please read these Terms of Use carefully before accessing or using the QwikSELL website or mobile application (collectively referred to as the "Platform").

These Terms of Use ("Terms") govern your access to and use of the Platform. The Platform is available for use only on the condition that you accept these Terms in full. If you do not agree with any part of these Terms, you must not access or use the Platform.

By accessing or using the Platform, you ("you", "your", or "User") confirm that you agree to be legally bound by these Terms.

Legal Relationship

These Terms constitute a legally binding agreement between you and Reown Device Private Limited ("Reown", "we", "our", or "us").

QwikSELL is a technology platform that enables users to sell pre-owned electronic devices, including mobile phones, laptops, tablets, smartwatches, and other supported products. Reown facilitates quotation, pickup coordination, device verification, and payment through authorised partners.

Reown acts only as a platform facilitator and does not assume liability for fraudulent acts committed by users or third parties beyond its reasonable control.

User Declarations & Warranties

By using the Platform, you confirm and warrant that:

• You are at least 18 years of age and legally competent to contract
• You are the lawful owner of the device listed for sale
• You have the full legal right and authority to sell the device
• The device is not stolen, counterfeit, or restricted under any law
• The address provided at the time of order is your correct residence or office
• All information shared on the Platform is true, accurate, and complete

You acknowledge that Reown relies on this information to provide services.

Quotes, Inspection & Sale Finalisation

• All price quotes generated on the Platform are provisional and subject to physical and functional verification of the device.
• Reown reserves the right to modify or withdraw any quote after inspection if:
• The device model differs from declared details
• Parts or accessories are missing
• The device condition does not match stated inputs

If you accept the final verified price and payment is processed, the sale becomes final and binding, and device ownership is deemed transferred.

Once sold, the device cannot be returned under any circumstances.

Documentation Requirements

For completing a sale, you may be required to provide:

• Self-attested government issued identity proof
• A self-attested indemnity declaration (as prescribed)

Failure to provide required documentation may result in cancellation or suspension of services.

Lawful Sale & Compliance

You agree that:

• The device sale does not violate any law, regulation, or export restriction
• The device and its software are free from legal encumbrances
• No intellectual property rights are unlawfully transferred

You shall indemnify Reown against any claims arising from violation of these obligations.

Data Responsibility

You are solely responsible for backing up and erasing all personal data from your device before handing it over.

Reown and its partners shall not be responsible for:

• Residual data remaining due to technical limitations
• Data recovery requests after device handover

Pickup & Order Fulfilment

• You must ensure device handover during the confirmed pickup window.
• If handover fails, up to two additional pickup attempts may be made.
• Repeated failure may result in order cancellation.

Platform Usage & Restrictions

You agree not to:

• Misuse or exploit Platform content for commercial purposes
• Use automated tools, bots, or scrapers
• Attempt unauthorised system access
• Submit false or misleading information

Reown may suspend or terminate access for violations.

User Consent & Communication

By registering, you consent to:

• Storage of your contact details in Reown's systems
• Receiving transactional communications via SMS, email, WhatsApp, calls, or in-app notifications

Communication preferences may be managed subject to applicable laws.

Lien Rights (If Applicable)

Reown may exercise a lien on collected goods in case of unpaid dues related to services rendered, after reasonable notice, in accordance with applicable laws.

Fees & Taxes

• Additional services may attract separate charges
• All fees are subject to applicable taxes under Indian law.
• Users are responsible for statutory compliance, deductions, and withholding obligations, if any.

Limitation of Liability

Reown shall not be liable for claims arising from:

• User misrepresentation
• Acts or omissions of third parties
• Government actions
• Force majeure events
• Disputes between buyers and sellers

To the maximum extent permitted by law, Reown's liability shall not exceed the value of the completed transaction.

Indemnity

You agree to indemnify and hold Reown harmless from claims or losses arising from:

• Breach of these Terms
• Violation of law
• Third-party rights infringement

Modification of Terms

Reown reserves the right to amend these Terms at any time. Updates become effective upon publication on the Platform. Continued use constitutes acceptance.

Governing Law & Jurisdiction

These Terms are governed by the laws of India

Exclusive jurisdiction shall lie with courts at New Delhi.
