Welcome to QwikSELL, operated by Reown Device Private Limited ("Reown", "we", "our", or "us"). These Terms & Conditions ("Terms") govern your access to and use of the QwikSELL website, mobile application, and related services (collectively referred to as the "Platform"). This document is an electronic record prepared in accordance with the Information Technology Act, 2000 and applicable rules thereunder. This electronic record does not require any physical or digital signature.

About QwikSELL

QwikSELL is an online platform that enables users to sell pre-owned and used electronic devices, including but not limited to:

Mobile phones (smartphones and keypad devices)
Laptops and tablets
Smartwatches and other supported electronic products

The Platform facilitates device valuation, order creation, pickup coordination, quality checks, and payment processing through authorised partners.

Acceptance of Terms

By accessing, browsing, registering, or using the Platform in any manner, you:

Confirm that you have read and understood these Terms
Agree to be legally bound by them
Agree to comply with all applicable laws and policies

If you do not agree to these Terms, you must immediately stop using the Platform.

REOWN reserves the right to modify or update these Terms at any time. Continued use of the Platform after such changes constitutes acceptance of the updated Terms

Eligibility

You must be capable of entering into a legally binding contract under the Indian Contract Act, 1872 to use the Platform.

Minors may use the Platform only with the consent and supervision of a parent or legal guardian.
Guardians may contact the Grievance Officer for concerns related to a minor’s information.

Nature and Availability of Services

Services are provided on a best effort, “as is”, and “as available” basis.
REOWN may engage third party service providers for logistics, verification, payment processing, diagnostics, or technical operations.
REOWN does not guarantee uninterrupted or error free access to the Platform.

REOWN retains the right to modify, suspend, restrict, or discontinue any part of the Platform without prior notice.

User Accounts and Verification

Account Registration

To access services, users must register using accurate and complete information. Each user is permitted one account, unless explicitly approved otherwise.

Account Responsibility

You are responsible for:

Maintaining the confidentiality of login credentials and OTPs
All actions taken through your account
Information submitted during order creation

Any activity performed through your account will be deemed authorised by you.

Verification

REOWN may verify user details directly or through authorised third party service providers. Incorrect or misleading information may lead to suspension or cancellation of services.

Selling Devices via QwikSELL

You may sell only devices that you legally own and are authorised to sell.
Device pricing is determined based on information provided by you and is subject to physical and functional verification.
If a mismatch is identified, a revised offer (if applicable) will be shared before proceeding.
You may accept or decline any revised offer without obligation.

Payments

Payments are processed via authorised banking and payment partners.
Payment timings and modes may vary based on verification, location, and partner availability.
Reown is not responsible for delays caused by banking systems or external service providers.

User Conduct

You agree not to:

Scrape, reverse engineer, or misuse Platform data
Upload or transmit unlawful, harmful, defamatory, or infringing content
Attempt unauthorised access to systems or accounts
Submit false, misleading, or fraudulent information
Use the Platform for unauthorised commercial activity

Violation of these obligations may result in suspension, termination, or legal action.

Suspension and Termination

Reown may suspend or terminate access if:

These Terms are violated
Fraud or misuse is suspected
Required by law or regulatory authorities

Inactive accounts may be deactivated at Reown's discretion.

Intellectual Property

All content on the Platform, including text, graphics, software, logos, and design elements, is the intellectual property of Reown Device Private Limited or its licensors. No content may be copied, reproduced, distributed, or exploited without prior written consent.

Third Party Links & Services

The Platform may contain links to third-party websites or services. Reown does not control or endorse such services and is not responsible for related transactions or policies.

Limitation of Liability

To the maximum extent permitted by applicable law:

Reown shall not be liable for indirect, incidental, consequential, or punitive damages.
Reown's total liability, if any, shall not exceed the value of the transaction completed through the Platform.

Indemnity

You agree to indemnify and hold harmless Reown, its directors, officers, employees, and service providers from claims arising due to:

Breach of these Terms
Violation of law
Infringement of third-party rights

Privacy

Use of the Platform is subject to our Privacy Policy, available at:

Force Majeure

Reown shall not be liable for failures caused by events beyond reasonable control, including natural disasters, system outages, governmental actions, pandemics, or network failures.

Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts located in New Delhi shall have exclusive jurisdiction.
